Hemco Invest’q terms and conditions of sale apply to any offer for a product from Hemco Invest BV to the Client.
Hemco Invest delivers exclusively in Belgium, Denmark, Germany, France, Italy, Luxembourg, the Netherlands, Austria, Spain, the United Kingdom, Ireland and Sweden. Hemco Invest supplies Hemco Invest 1 pushchairs exclusively in Belgium and the Netherlands. Hemco Invest reserves the right to refuse the order for orders with a delivery address in a country other than those stated above.
To place an order, you must be over 18 years old and not be legally incapacitated and have a valid e-mail address. If Hemco Invest BV learns that an order has been placed by a minor, Hemco Invest reserves the right to refuse the order.
To use your Hemco Invest stroller, you must have a mobile device with internet access and a GPS signal. To start using your Hemco Invest stroller, you must first download the Strollo app (available on the App Store and Google Play) and activate your personal Strollo account. The Strollo app can be downloaded and used for free. The terms of use of the Strollo app apply to this.
You are solely and exclusively responsible for all aspects of your stroller trips, including compliance with any road, traffic and insurance rules that may apply to you. These rules may differ per country. It is your responsibility to verify that you comply with all regulations in this regard. For example, in Belgium you must equip your stroller with front, rear and wheel reflectors and a stroller to comply with the highway code.
The costs for using your Hemco Invest stroller and the app are at your own expense, including any costs related to your mobile device, Internet connection, GPS, battery recharge, and reflectors.
By placing an online order on the website, you formally accept Hemco Invest's Terms of Sale, Strollo App Terms of Use and Hemco Invest's Data Protection Policy. You will find these on our website.
Hemco Invest expressly states in its offer whether this is valid for a limited period and whether specific conditions apply that are different from those set out in these terms and conditions of sale.
Hemco Invest provides a clear, complete and accurate description of the products sold to you, as well as the steps in the Hemco Invest delivery process.
The purchase agreement between us is entered into as soon as Hemco Invest confirms your order in writing. The confirmation follows after Hemco Invest has received approval from the issuer of your card. Orders without valid payment in the name of the registered cardholder will not be accepted or processed by Hemco Invest. When using the bank card of another cardholder, you confirm that you have permission to use that bank card for the purchase at Hemco Invest and to make the payment with it. Should the issuer of your card refuse to authorize your payment to Hemco Invest, Hemco Invest cannot be held liable for delays in delivery and/or non-delivery of your order. Hemco Invest accepts the following payment methods: Visa, MasterCard and Bancontact.
Hemco Invest BV must deliver the goods within 30 days after it has confirmed the order in writing.
To purchase a product, add it to your shopping cart. Then fill in your contact details and billing information. You then confirm the delivery via Mondial Relay. The last step will take you to an overview page. By clicking the “order and pay” button, you accept the terms and conditions of Hemco Invest. After completing these steps, your order becomes final.
If you are a consumer, you have the right to cancel your purchase and return the order without giving any reason and without additional costs (apart from the return shipping costs). If you cancel the purchase, you will lose access to the Strollo app.
The cancellation period expires 14 days after the day on which you or a third party, other than the carrier and indicated by you, physically takes possession of the goods. If the goods are delivered in several batches or parts, the cancellation period will expire 14 days after the day on which you take physical receipt of the last lot or part.
Please note: the right to cancellation does not apply if goods are manufactured according to the customer's specifications or are clearly personalized.
You must return or hand over the goods to Hemco Invest without undue delay and in any event not more than 14 days after you have notified us that you are cancelling this agreement with us. The deadline is met if you return the goods before the period of 14 days has expired. The direct costs of returning the goods are for your account.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. Installing the pedals and/or straightening the handlebars and/or adjusting the height of the seat may cause minor scratches, reducing the value of the stroller. Insofar as these actions are not necessary to determine the nature, characteristics and functioning of the stroller, you are liable towards Hemco Invest for any depreciation caused by these actions.
If you return the goods to Hemco Invest, Hemco Invest may refuse reimbursement until it has received the returned goods or until you have demonstrated that you have sent back the goods, whichever occurs first.
Hemco Invest must repay you no later than 14 days after the day on which it has received the goods returned by you. If Hemco Invest offers to collect the goods themself, you will be reimbursed within 14 days from the day on which you have informed Hemco Invest that you are cancelling the purchase agreement.
Hemco Invest must use the same method of payment as used by you in the original transaction, unless you have expressly agreed otherwise, and provided that you do not incur any additional costs for such reimbursement. Hemco Invest does not reimburse the additional costs if you have expressly chosen a delivery that is not the cheapest standard delivery that Hemco Invest offers.
You must handle the order and the packaging with the utmost care during the first 14 days after delivery. As a consumer, you are liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics and functioning. To determine the nature, characteristics and functioning of the goods, you should only handle and inspect the product in the same way as you would be allowed to do in a shop.
To exercise your right of cancellation, please fill in the attached form (or make an unambiguous statement with the same sound) and send it by post or e-mail, as mentioned in point 1 above. We will send you a confirmation of your cancellation.
The applicable prices are the prices that apply at the time the purchase agreement is entered into. During the period that Hemco Invest mentions in its offer, Hemco Invest's prices do not change; price changes due to changes in tax rates are an exception to this.
Unless otherwise provided, the prices quoted are inclusive of VAT and all other taxes, and exclusive of shipping costs. The shipping costs may vary depending on the delivery method and country of delivery.
Hemco Invest always informs you of the total price before proceeding to your order.
We only accept payment in advance through our website using the payment methods listed on our website (see art. 4 above).
To ensure secure online payment and the safety of your personal data, the transaction data is only sent via encryption with SSL technology. SSL payments do not require any special software.
If you are a consumer, you have a legal guarantee of 2 years on the goods you have purchased from Hemco Invest
All products are delivered to the address that you have provided to Hemco Invest BV as the delivery address or address where the services are performed.
The delivery time indicated by Hemco Invest must be based on the circumstances that apply to Hemco Invest when the agreement was entered into.
Unless the parties have agreed on a different delivery time, Hemco Invest must physically deliver the goods or transfer control of the goods to the consumer without undue delay and no more than 30 days from entering into the agreement.
Insofar as Hemco Invest has failed to fulfil its obligation to deliver the goods at the time agreed with you or within the period agreed with you, given time frame, you should request Hemco Invest to make the delivery within an additional time period appropriate to the circumstances. If Hemco Invest fails to deliver the goods within that additional time period, you have the right to terminate the agreement.
Delivery takes place via Mondial Relay. The process is as follows: (1) you make an appointment and (2) the stroller is delivered to the place you have indicated.
When Hemco Invest ships the goods to you, the risk of loss or damage to the goods passes to you as soon as you or a third party designated by you, other than the carrier, physically takes possession of the goods. However, the risk passes to you upon delivery to the carrier if the carrier has been instructed to transport the goods and that choice has not been offered by Hemco Invest, whereby your rights against the carrier remain unaffected.
If Hemco Invest is unable to fulfil any of its obligations towards the Client due to force majeure, these obligations will be suspended during the force majeure situation.
Cases of force majeure are considered: all circumstances beyond the will and control of Hemco Invest, which make it impossible to fulfil our obligations in whole or in part. Such cases include strikes, fire, interruption of energy supplies or telecommunication networks or communication systems and/or the temporary failure of the web shop, delayed delivery or no delivery by suppliers or other third parties.
All content that we make available to you through our website and all other means of communication, including software, images, graphics, logos, documents, text, slogans, user content and other information ("Content"), as well as all related intellectual property rights (including copyrights, database rights and trademark rights) and other rights, are our exclusive property, or are the property of their respective holders.

To the fullest extent permitted by applicable law, we are not liable for any damage caused by our products, unless there is an intentional fault.
In any case, our liability is excluded for indirect damage such as damage resulting from an accident, loss of income, loss of productivity and loss of data, or for moral damage such as damage to reputation.
The limitation of liability in the paragraphs above applies to the fullest extent permitted by applicable law, regardless of the applicable liability regime, and even in cases of gross negligence.
If Hemco Invest is held liable for a certain damage despite the foregoing provisions, the liability of Hemco Invest is in any case limited to the price paid by you for the relevant Hemco Invest products or to the amounts actually paid to Hemco Invest by his insurance for compensation of the damage in question, the highest amount being applicable.

These terms and conditions are exclusively governed by Belgian law, regardless of where you live. Only the courts of the place where our registered office is located are competent to settle disputes concerning these terms and conditions, without prejudice to the applicable mandatory law, which provides that the courts of your place of residence have jurisdiction.

If, for any reason whatsoever, any provision of this agreement is found to be invalid, void or unenforceable, that finding shall not affect the validity of the remaining provisions. In such a case mandatory and the parties agree to replace the provision that is found to be invalid, void or unenforceable by mutual agreement with a new provision that approaches the purposes of the parties as closely as possible and that contains the spirit of these terms and conditions.
Failure or omission to comply with any provision shall not render such provision invalid.
